7. Premium Services

When subscribing to a premium service such as Dream Picks, you are required to provide your name, email address, and billing information, including your credit card details. BY SUBMITTING YOUR PAYMENT INFORMATION, YOU AUTHORIZE THE WALL STREET DREAM TO CHARGE YOUR CREDIT CARD FOR THE SUBSCRIPTION FEE AND ANY SUBSEQUENT RENEWAL FEES UNLESS YOU CANCEL.

You confirm that all information you provide is accurate and agree to update it as necessary. It is your responsibility to ensure that your credit card and contact details remain current. If any information you provide is found to be inaccurate or outdated, The Wall Street Dream reserves the right to cancel your subscription. In the event that your credit card expires, is terminated, or is otherwise rejected by the issuing company or payment processor, The Wall Street Dream may immediately cancel your Service or suspend access until valid, up-to-date information is provided.

We retain the right to refuse or discontinue the provision of our Services to any user at our discretion. The Wall Street Dream does not guarantee the perpetual continuation, functionality, or availability of any current or future Services. Our offerings may evolve over time due to various factors, including market demands, regulatory changes, and business strategy adjustments.

If you are subscribed to a Service that we discontinue before the end of its term, The Wall Street Dream will issue a refund based on the proportion of the Content already delivered to you under your Service. Please note that The Wall Street Dream retains sole discretion to determine the appropriate refund amount, aiming to be fair and reasonable in such situations.

Membership grants you access to a dedicated members area on our website, and we keep you informed of the Dream Picks Service via essential email updates. There is no option to opt out of these emails unless you cancel your subscription or unsubscribe via the link provided, although we do not recommend unsubscribing, as you will miss important updates regarding Dream Picks.

The Wall Street Dream reserves the right to modify, suspend, or discontinue any part of our Services at any time, including pricing, which will be communicated to you with reasonable notice. We may limit sales of our Services to specific individuals or regions and will notify you promptly of any significant changes impacting your access.

You have the right to cancel your Service at any time. However, no refunds will be issued for cancellations made before the end of your current billing cycle. Upon cancellation, you will retain access to your Service content until the end of your billing cycle.

The Wall Street Dream also reserves the right to limit, suspend, or terminate your access to our Services at any time and for any reason, with or without prior notice. In such cases, you will not be entitled to a refund of any fees already paid, and our decisions regarding your access are final.

You acknowledge and agree to these Terms, understanding that unauthorized sharing or redistribution of our Content is strictly prohibited and may result in legal action.

WE DO NOT GUARANTEE THAT ANY ERRORS WILL BE PROMPTLY CORRECTED OR THAT THE CONTENT IS FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

THIS INCLUDES, BUT IS NOT LIMITED TO, ANY LOSS OR INJURY CAUSED BY THE COMPANY'S NEGLIGENCE OR FACTORS BEYOND ITS CONTROL IN CREATING OR DELIVERING ITS SERVICES, AS WELL AS DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, SAVINGS, REVENUES, AND ANY OTHER INTANGIBLE LOSSES. THIS LIMITATION APPLIES REGARDLESS OF WHETHER THE WALL STREET DREAM WAS ADVISED OF OR COULD HAVE FORESEEN THE POSSIBILITY OF SUCH DAMAGES.

WHERE THE LAW DOES NOT PERMIT SUCH A BROAD LIMITATION OF LIABILITY, THE LIABILITY OF THE WALL STREET DREAM SHALL BE LIMITED TO THE GREATER OF (A) THE TOTAL AMOUNT PAID FOR SERVICES THREE (3) MONTHS PRIOR TO THE DATE OF THE INITIAL CLAIM MADE AGAINST THE WALL STREET DREAM, OR (B) SIXTY UNITED STATES DOLLARS (USD$60).

12. Indemnification

You agree to indemnify and hold harmless The Wall Street Dream, including its directors, shareholders, employees, affiliates, and any other parties involved in the delivery of our Services, from and against any and all claims, losses, damages, liabilities, and other costs (including reasonable attorneys' fees) that arise directly or indirectly from your breach of these Terms and Conditions or any violation of laws, regulations, or rights of others in connection with your use of our Services.

In the event of any claim for which we seek indemnification from you, you agree to provide a defence at your own expense and to cooperate fully with us in the defence of any such claim.

13. Arbitration and Actions

You acknowledge that, before initiating any formal dispute resolution, we encourage both parties to attempt resolution informally. In the event of a dispute ("Dispute") related to your use of our Services or these Terms, both parties agree to first contact each other via email with a detailed description of the Dispute and any proposed resolution. You should email your concerns to contact@wallstreetdream.com, and we will respond using the email address we have on file for you.

If the Dispute cannot be resolved informally, you agree that any claim, controversy, or Dispute arising out of or relating to your use of our Services or these Terms will be settled by private and confidential binding arbitration. The arbitration will be conducted before a single arbitrator in St. John’s, Newfoundland and Labrador, Canada, and will be held in English. The arbitration will be governed by the laws of Newfoundland and Labrador, specifically the Arbitration Act, as amended, replaced, or re-enacted from time to time.

Notwithstanding the agreement to arbitrate, we reserve the right to seek protection of our intellectual property rights and confidential information through injunctive or other equitable relief through the courts.

BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND AGREE TO RESOLVE ALL CLAIMS INDIVIDUALLY THROUGH ARBITRATION, WAIVING ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING.

14. Miscellaneous

These Terms are governed by the laws of the Province of Newfoundland and Labrador and the applicable laws of Canada, without giving effect to conflict of laws principles. Subject to the Arbitration and Actions section, you agree and submit to the jurisdiction of the Federal Court of Canada and/or the courts of the Province of Newfoundland and Labrador regarding any matters arising from these Terms.

These Terms constitute the entire agreement between you and The Wall Street Dream regarding the use of our Services. We reserve the right to correct any typographical errors, inaccuracies, or omissions and to update information at any time without prior notice. Our Services are administered from within Canada and are intended primarily for users residing in Canada. We do not warrant the appropriateness or legal compliance of our Services outside Canada; if accessed from other locations, it is your responsibility to ensure compliance with local laws.

You understand that The Wall Street Dream cannot be held responsible for any harm resulting from third-party impersonation, deception, or unauthorized access to your account due to impersonation or misleading information provided to us. It is solely your responsibility to safeguard your account credentials and keep your username and password secure, notifying us promptly of any unauthorized use.

By using our Services, you acknowledge and accept the risks associated with the potential for unauthorized use or impersonation, as well as the inherent limitations in verifying the identity of all users. You agree that The Wall Street Dream is not liable for actions or outcomes arising from deception or impersonation.
